General terms and conditions of sale

Sales made on the website www.mymarketma are exclusively reserved for individuals and legal entities with an email address and a delivery address located within one of the areas served by My Market. To find out if your desired delivery location is within the My Market service area, please enter the postal code of your desired delivery location in the designated field on the registration page.

No deliveries or after-sales services will be provided outside this territory. These general terms and conditions of sale and the specific terms and conditions of sale applicable to each item offered on the website govern the sole relationship between RIZKOUNER sarl E-Commerce Maroc and its customers, to the exclusion of all other terms and conditions.

1. ACCEPTANCE OF TERMS AND CONDITIONS

Any order confirmation placed by the customer on the website www.mymarket.ma (hereinafter the "Site") implies acceptance of these general terms and conditions of sale of RIZKOUNER Sarl, governed by Moroccan law, and acceptance of the specific terms of their order (items ordered as presented on the Site, within the limits of the quantities indicated). Therefore, no order can be sent without the customer having first expressly indicated, by checking the box provided for this purpose, that they have read and accept these general and specific terms and conditions of sale. It is further specified here that the customer has, before this confirmation, a mechanism allowing them to correct or modify their choices. This mechanism is accessible at each stage of the order placement process.

2. PRODUCTS

2.1 Product and service offerings

The list and characteristics of products offered on MYMARKET.MA are subject to change and adaptation at any time to better meet customer expectations. The products and services offered on MyMarket.ma comply with Moroccan law and applicable standards in Morocco.

To ensure the availability of products sold by MyMarket.ma (Rizkouner SARL) to its customers, particularly during promotional offers, MyMarket.ma (Rizkouner SARL) reserves the right to refuse to fulfill all or part of an order deemed abnormal in view of the quantities of products usually ordered by a consumer.

2.2 Product Availability

Products and services are available at the prices and under the conditions offered as long as they are visible on the Myarket.ma website (subject to availability). Product availability information comes directly from our suppliers and service providers, including RIZKOUNER sarl, and may occasionally be incorrect or inaccurate. In such cases, MyMarket.ma will provide the customer with any additional information necessary for the proper processing of their order. Upon order confirmation, MyMarket.ma will confirm the availability of the ordered products to the customer. In the exceptional event that product availability information is incorrect, MyMarket.ma will inform the customer by email or telephone and provide any additional information necessary for the proper processing of their order.

3. USERNAME AND PASSWORD

During the first order, and in order to personalize each customer's experience, a username and password are chosen and entered by the customer. The system then checks the uniqueness of the username and password. The username and password serve as proof of the customer's identity and bind them to any order placed using them.

The customer is solely responsible for their username and password. They will bear all consequences that may result from any use by third parties who have obtained this information, unless they can demonstrate that the disclosure of their username and password resulted from MyMarket.ma's negligence.

If you forget your password or username, or if you suspect that someone else may have obtained it, you can use the website to retrieve your username and choose a new password. The system will then automatically delete any bank details saved from a previous order. MyMarket.ma complies with Law 09-08 of June 18, 2009, concerning the protection of individuals with regard to the processing of personal data. You have the right to access, rectify, or delete your personal data.

4. CONTRACT FORMATION: PROCEDURE AND EVIDENCE

4.1 Order registration, sending or collection

An order placed on the MyMarket.ma website is not limited by a minimum total amount (cost of goods including VAT, excluding service fees) or by maximum quantities. Each order is summarized before the customer is asked to confirm it by indicating their choices regarding the date, time slot (subject to availability), delivery address, and payment method. The customer then has the opportunity to correct or complete their order. The customer is then asked to "validate and pay"; this order confirmation by double-clicking constitutes firm and final validation, subject to the condition mentioned in the following paragraph. Any order with payment by bank card or debit card is considered effective only once the relevant payment centers have given their approval. In the event of refusal by these centers, the order is automatically canceled, and the customer is notified by an on-screen message.

4.2 Confirmation of order receipt by MyMarket.ma, order preparation and contract formation

MyMarket.ma confirms receipt of the customer's order. This confirmation is sent to the customer by email, summarizing the products ordered, the delivery date and time slot, the chosen payment method (cash on delivery, online by credit card, or by check upon delivery), and indicating an order number. All prices mentioned in this email include VAT. The possible unavailability of certain items on this date does not affect the order of the other products. The customer is informed by email of any unavailable items, and their price is, of course, deducted from the total price of the order entered by the customer.

MyMarket.ma reserves the right to refuse an order for legitimate reasons, such as difficulties in obtaining a product, problems understanding the order received (illegible document, etc.), foreseeable delivery issues (e.g., delivery requested to a geographical area with a proven risk of assault or verbal or physical threats against our delivery drivers or damage to our delivery trucks), or the unusual nature of the order placed on our website. Orders placed on our website will be considered unusual if they are not in the same situation as a new order from a customer with whom there is an ongoing dispute regarding payment for a previous order, if the delivery address is inconsistent, or if the order exceeds the usual needs of a consumer and risks making delivery impossible for our other customers.

If an order cannot be accepted for one of the aforementioned reasons, MyMarket.ma will inform the customer by email. The customer is specifically asked to regularly check their email inbox for any messages that may be sent by MyMarket.ma regarding the invalidity of their order or the inability to proceed with delivery.

The sales contract is finalized upon confirmation of the order by double-clicking. The order is then confirmed to the customer by sending a confirmation email. Risk is transferred to the customer upon home delivery or collection of the order from a collection point if the customer has chosen this delivery method. The information provided by the customer when placing the order is binding: in the event of an error by the customer in providing their contact details or those of the delivery address, including their name, surname, address, telephone number, email address, or bank or payment card number, resulting in the loss of the products, the customer remains responsible for payment for the lost products.

4.3 Evidence

MyMarket.ma's automatic recording systems are considered valid proof of the nature, content, and date of the customer's order, the nature, content, and date of the order confirmation received by MyMarket.ma, and the nature, content, and date of any email exchanged between MyMarket.ma and the customer. Information relating to any transaction carried out using the customer's login credentials will be stored and archived by MyMarket.ma in accordance with applicable Moroccan law and will serve as evidence in the event of a dispute with the customer. This information will be legally binding in the event of a disagreement between the parties and will be retained by MyMarket.ma for the applicable statutory limitation period.

5. PROMOTIONAL CODES - EXPIRY DATE - FREE DELIVERY OFFERS

Promotional offers available on the site are subject to conditions:

  • Promotional offers are accessible via a promotional code, which you simply need to enter on the "shopping cart summary" page with each order to take advantage of them.
  • They are limited to one offer per household (same name, same postal address). Promotional offers may be deducted from the original price, or products may be free. Promotions on products nearing their expiration date are listed on each product page. PROMOTIONS , they are subject to NON-RETURN or exchange, and not refundable except in the case of a hidden defect.

6. DELIVERY

6.1. Delivery methods

Delivery is carried out by MyMarket.ma 's delivery drivers or service providers in Morocco, within the delivery zones served by MyMarket.ma . The location and date for delivery are chosen by the customer from the various time slots offered by MyMarket.ma during the ordering process. The customer agrees to take possession of the goods upon arrival.

  • Delivery will be made to the customer's home address (as provided when placing the order), at the times and dates agreed upon with MyMarket.ma. The customer agrees to provide proof of identity with one or more valid official documents and by providing the order number assigned by the system and sent to them in the order confirmation email from MyMarket.ma. Delivery will be made to the customer's door.
  • AT THE HOME OF A THIRD PARTY OF THEIR CHOICE at the times and days agreed upon with MyMarket.ma when placing the order. In this case, the third party must also agree to provide proof of identity with one or more valid forms of identification and to provide the order number assigned by the system, which was sent to the customer in the order confirmation email from MyMarket.ma. Delivery is made to the customer's door.
  • AT THE PICKUP POINT: From the date the customer is notified that their order is available for pickup. When picking up the order, the customer agrees to provide proof of identity by presenting one or more valid official forms of identification and to provide the order number assigned by the system and communicated to the customer in the order confirmation email. Once collected, the products belong to the customer and are therefore their responsibility.
6.2. Order Receipt

Upon delivery, the customer is obligated to check the condition of the package. In the event of any discrepancies upon delivery, the customer must note their reservations on the delivery slip or refuse the merchandise. For home delivery or in-store pickup, the customer can verify the conformity of the ordered products by unpacking them. Conformity of the order is understood to mean the presence of the products, their accuracy in relation to the order, and their apparent condition.

The customer also agrees to sign the delivery slip presented by the MyMarket.ma representative or the staff at the collection point, or to authorize the third party receiving the goods to sign this slip, on which any necessary remarks regarding the order or the number of items delivered may be noted. Signing the delivery slip and indicating the number of packages received constitutes acknowledgment of delivery.

In the event that the customer finds, after opening the packages, damaged or missing products, it is his responsibility to contact Customer Service within three (3) working days to obtain an exchange or refund of the products subject to the return of the products to MyMarket.ma.

If MyMarket.ma is unable to make a delivery, the customer will be informed as soon as possible by any means, such as email or telephone. In this case, MyMarket.ma will also reimburse the delivery costs as compensation, except in cases of force majeure. Similarly, if the customer is unable to collect the products at the agreed delivery time (day and time slot), they must inform MyMarket.ma as soon as possible by any means, such as email or telephone.

Unless otherwise agreed by MyMarket.ma , delivery costs remain the responsibility of the customer in this case.

6.3. Delivery charges

Delivery charges are the responsibility of the customer, except in specific cases where MyMarket.ma covers them. Delivery services are billed according to the schedule below. The exact amount is specified before order confirmation.

6.4. Delivery times:

Delivery times can vary from 24 hours to 20 business days depending on the product(s) ordered. Once paid, orders cannot be cancelled; no returns are accepted. If the customer decides to abandon their order, the fresh products will be automatically destroyed.

Delivery address: Mymarket may hold your order if the address you provide at checkout is incomplete or incorrect. Fresh products will be destroyed for food hygiene reasons, and you will be responsible for the cost of reshipping.

MyMarket.ma reserves the right to block a customer if it involves fraudulent activity or repeated cancellations.


Perishable or rapidly deteriorating goods (opened beverages); 7. WITHDRAWAL

7.1 Right of withdrawal

In accordance with legal provisions, the right of withdrawal applies only to consumer clients. The consumer has a period of 7 (seven) clear days from the date of collection of the product or delivery of the product to their home to exercise their right of withdrawal, or from the date of taking possession of the last item, or when the order consists of several items.

7.2 Exclusions from the right of withdrawal

The following are not eligible for a right of withdrawal:

  1. The services are fully performed if the consumer has given their express prior consent to their performance, and acknowledged that they would lose their right of withdrawal after performance of the contract;
  2. Goods manufactured specifically or customized at the consumer's request;
  3. Sealed goods that cannot be returned for health or hygiene reasons and that have been unsealed by the consumer after delivery (food, cleaning, hygiene, etc.)
  4. Sealed audio or video recordings or software that have been unsealed after delivery;
  5. Digital content not supplied on a tangible medium if performance has begun with the consumer's prior express consent;
  6. And more generally any good which, by virtue of its nature, after delivery is no longer identifiable because it has become inseparably mixed with other products.
  7. Products on promotion and clearance: Groceries, household appliances, electronics, hygiene products, etc... are not subject to cancellation/refund or exchange (in case of hidden defect, or deterioration of the product, a supplier guarantee is provided to you and you can take advantage of it).
  8. In the event that the customer is unavailable, refuses the order or does not show up on the same day to collect their order (drive for example), fresh products cannot be refunded: Fruits, vegetables, dairy products, creamery, fish, meats, ... Also delivery fees will not be refunded.
  9. A product in perfect condition but used repeatedly cannot be returned.
7.3 Cancellation Procedures

To withdraw, the customer can:

  • Send a cancellation email to support@mymarket.ma
  • Contact customer service (see article 14 below)

In all cases, the withdrawal document must include at a minimum the customer's first and last names, as well as their order number and invoice.

7.4 Conditions and procedures for return

In accordance with current regulations, "the consumer must return the goods to the professional or a person designated by the latter, without undue delay and, at the latest, within seven (7) days of communicating their decision to withdraw in accordance with Article L. 121-21-2, unless the professional offers to collect the goods themselves." The product must be returned by the customer, at their own expense (unless they opt for free return shipping via the MyMarket.ma carrier – recommended to avoid theft and loss), in its original and complete condition (accessories, instructions, etc.), and must be accompanied by the purchase invoice, to the address indicated on the return form. In accordance with Article L.121-21-3 of the Consumer Code, "the consumer can only be held liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the goods." Incomplete, damaged, or defective returned items, items that have been in contact with hazardous chemicals, or items in such a state of soiling that they are unsaleable due to depreciation will be returned to the customer; the customer may be held liable in such cases. Original packaging must be carefully protected to prevent damage by being packed and secured in sturdy, suitable cardboard boxes. Similarly, any service performed on behalf of the customer, and with their consent, before the expiry of the seven (7) calendar day period will not be eligible for a refund. The customer is responsible for the proper shipment of the products and, in particular, for obtaining ad valorem insurance for these products.

7.5 Refund Terms

If the customer exercises their right of withdrawal in accordance with applicable regulations, MyMarket.ma undertakes to reimburse the customer within twenty (20) days from the earliest of the following dates:

  • receipt of the goods in their entirety,
  • receipt of proof of shipment of the entire item (mentioning the sender, the recipient and the product shipped).

The refund will be issued using the same payment method used by the customer, unless the customer requests a credit note. If a credit note is chosen, it cannot be exchanged for its cash value and will be valid for one year from the date of issue. If the credit note is only partially used, the remaining balance will remain available to the customer under the same conditions as the original credit note. The customer is informed that the refund of initial delivery costs will be calculated proportionally to the weight of the returned items. Therefore, if the customer returns all the goods in their order, they will be refunded the full initial delivery costs. If the customer benefited from a promotional offer when placing their order, they will be refunded the price they actually paid or the price they would have paid if they no longer meet the eligibility requirements. Similarly, if the right of withdrawal is exercised on a product that has benefited from a loyalty program credit, the benefits granted will be immediately debited from the loyalty account.

8. PRICE

All orders (products and services) are payable in MAD (Moroccan dirhams). Product and service prices are subject to change and are updated daily. The prices charged are those in effect on the day the order is validated. They are listed on the product and service descriptions and on the order summary. The prices indicated on the product lists and on the pages titled "Detailed Information" do not include delivery charges. Delivery charges are shown on the website, during the order summary, before the customer confirms the order by double-clicking. The total price including VAT shown in the order confirmation is the total price of the order, inclusive of all taxes and VAT. Prices displayed on the website are valid only for online purchases.

9. Processing your order

9.1 Information when ordering

The customer is responsible for the completeness and accuracy of the information (delivery address, collection point, bank details, delivery constraints, etc.) validated during the order.

9.2 Order tracking

By visiting the Site, the customer can track the status of their order from the moment it is validated and for a period of one (1) year. They can also access, upon simple request to MyMarket.ma customer service , the details of their orders for a period of 10 years from the date of placing those orders.

10. Payment terms

10.1 Cash payment methods

To pay for their online order, the customer has access to all payment methods offered during the final order confirmation. Credit cards (Visa, Mastercard, and e-card), deposits, and bank transfers are accepted on the Site. The customer explicitly acknowledges having the right to use the payment method they have selected. For full online payments, the amount of the order actually delivered will be debited upon delivery.

10.2 Payment of an order by check

Payment by check is available for all orders. The check must be drawn on a bank located in Morocco.

If he chooses to pay by check, he makes it payable to MyMarket.ma and then hands over the check upon delivery, along with a presentation of one or more pieces of identification.

If payment by bank card or payment card, or payment by check, is not authorized, the order will not be made available to the customer.

MyMarket.ma participates in the fight against fraud involving payment methods (check and bank card) and unpaid invoices, consulting its partners as needed (see details in paragraph 13).

MyMarket.ma therefore retains ownership of the delivered items in all circumstances until full payment of the price by the customer and reserves the right not to proceed or to impose certain types of payment on the order of a customer who is subject to an unresolved unpaid debt or whose means of payment present anomalies.

10.3 Online Payment Security / Data Transmission

MyMarket.ma is committed to the security of online payments. Payment data is encrypted from the moment it is entered. It is impossible to read it during its single transfer over the internet. The only information subsequently transmitted on the MyMarket.ma website during the ordering process is a coded number associated with the payment card, which in no way allows the actual card number to be retrieved.

11. GUARANTEE Credit card payment

To pay for your order by bank card, you choose the payment method from those offered by www.mymarket.ma at the order form level (Visa, MasterCard, Maestro, cmi, Maestro, Diners Club and Discover).
In this case, the transaction will be debited from your account on the same day (subject to product availability from our suppliers) following the delivery confirmation date.


The Consumer warrants to RIZKOUNER sarl that he has the necessary authorizations to use the payment method chosen by him when validating the order form.
In the event of payment by bank card, the provisions relating to the fraudulent use of the means of payment provided for in the agreements concluded between the Consumer and the card issuer between the company mymarket Ma SARL and its banking establishment shall apply.


In the event of a stock shortage, the amount of the cancelled item(s) will either be deducted from the total amount debited or credited back to the account within 3 working days after the debit of the amount including the cancelled item(s), or a voucher valid for 1 year on all our MyMarket.ma items.


PAYMENT SECURITY

The electronic payment security system implemented by Payzone is certified by the Interbank Electronic Banking Center (CMI) and by Moroccan Banks as well as by the international organizations VISA and MasterCard.

The Payzone system ( www.payzone.ma ) guarantees the confidentiality of your banking data because it is based on the encryption of exchanged information and relies on standard technologies and concepts recognized and proven on the Internet. Furthermore, your banking data is transmitted directly to the Interbank Electronic Banking Center (CMI).

CMI handles the financial transactions between your bank account and our website's account.
To pay online by credit card, you must provide the type of payment card (cmi, VISA, MASTERCARD), the payment card number, the expiry date, and the CVV code. You guarantee that you are fully authorized to use the said card.

12. SUSPENSION OF THE VALIDITY OF A CUSTOMER'S ID

If a customer fails to pay the amounts due, MyMarket.ma may automatically and immediately suspend the validity of the customer ID.

13. CUSTOMER RELATIONS DEPARTMENT

For any difficulties, the customer can write by email via mail support@mymarket.ma.

15. LOYALTY POINTS

Loyalty points can be accumulated and converted into a voucher (excluding shipping costs) valid on the entire site.

15. PERSONAL DATA

15.1 Collection of personal data

In order to process, track, and archive orders, MyMarket.ma must necessarily process and collect personal data concerning the customer. This data may be transferred to service providers located outside Morocco. When this is the case, these transfers are processed in accordance with the recommendations of the European Commission.

The data processed by Google, Yahoo, and Facebook is transferred to the USA for the following purposes: personalization of your preferences, advertising and social network management.

The data is processed by MyMarket.ma, and where applicable, the relevant service providers and/or partners, according to the following terms and for the following purposes:

15.1.1 Order Management

Providing the personal data collected for the purposes of distance selling is mandatory for order confirmation, validation, tracking, and shipment; without this data, the customer's order cannot be processed. Mandatory data is indicated by an asterisk on the order form; other data fields are optional. This data may be shared with MyMarket.ma 's service providers .

  • solely for the purpose of the proper execution of the order and in particular its delivery, according to the options selected by the customer when placing the order (e.g., collection location); where applicable, these may be checked upon delivery;

  • the establishment of statistics.

15.1.2 Combating fraud

MyMarket.ma reserves the right to refuse an order from a customer who has previously experienced problems (fraud or non-payment). MyMarket.ma retains ownership of the delivered items until full payment is received from the customer. Information related to your order is subject to automated data processing for the purpose of determining a fraud risk level for each transaction, under the responsibility of MyMarket.ma.

In order to strengthen security and protection against potential identity theft or fraud attempts, the data collected by MyMarket.ma from its customers during the ordering process is used to analyze and assess the level of trust associated with each order. In the event of non-payment due to fraudulent use of a payment method, the contact details related to your order and associated non-payment will be recorded in a payment incident file maintained by MyMarket.ma. Any irregular declaration or anomaly may also be subject to specific processing. Furthermore, MyMarket.ma may retain data to enhance and manage its order analysis system. In accordance with Law 09-08 of June 18, 2009, concerning the protection of individuals with regard to the processing of personal data, you have the right to access, rectify, or delete your personal data held by MyMarket.ma, the data controller, by contacting us at support@mymarket.ma.

15.1.3 Combating bounced checks

Payment by check is accepted subject to verification with the Bank of Morocco's national register of irregular checks, and uses automated processing based on customer order information. MyMarket.ma may contact your bank to check your creditworthiness.

Consequences of fraud and non-payment

When a payment or order check reveals an outstanding balance, fraud, or attempted fraud, the customer may be added to a file listing fraud and outstanding balances until their situation is resolved. Under these circumstances, MyMarket.ma may refuse to fulfill orders from customers listed in this file until the situation is resolved. In all cases, the customers concerned will be notified individually.

In the event of a detected risk of fraud, MyMarket.ma reserves the right to carry out a check by telephone call or to cancel the order to guarantee the security of online transactions.

15.2 COOKIES

17.2 Force majeure

Events of force majeure, as defined by Moroccan law and jurisprudence, that render the performance of the sales contract by RIZKOUNER sarl absolutely impossible under the stipulated conditions constitute grounds for the suspension or termination of RIZKOUNER sarl's obligations if the event continues for more than one month. MyMarket.ma cannot be held liable for the non-performance of the contract in the event of any of the aforementioned events.

MyMarket.ma will be released from its obligation to deliver the scheduled order in the event of force majeure, including but not limited to situations where delivery is prevented, limited, or disrupted due to fire, explosion, transmission network failure, supply shortage, facility collapse, epidemic, earthquake, flood, ice storm, snow, power outage, war, embargo, law, injunction, demand or requirement of any government, strike, boycott, or any other circumstance beyond MyMarket.ma 's reasonable control or that would render delivery prohibitively difficult, as well as any unforeseeable and irresistible event beyond the control of the parties. In such cases, MyMarket.ma will inform the customer by email or other means of the impossibility of delivery due to force majeure and provide an estimate of when service will be restored. Similarly, the customer will be relieved of the obligation to accept the scheduled delivery, subject to prompt notification to MyMarket.ma , in the event of force majeure as commonly recognized by the courts. If the force majeure event continues for more than one month from its occurrence, the Parties may notify each other by registered letter with acknowledgment of receipt of the cancellation of the order without either party being entitled to compensation.

18. MODIFICATION

MyMarket.ma reserves the right to adapt or modify these terms and conditions of sale at any time. We encourage you to review them regularly. The applicable terms and conditions of sale are those in effect on the day of your order. With each new order, MyMarket.ma invites the customer to carefully review the current terms and conditions of sale.

19. ENTIRETY

The invalidity of one of the clauses herein, in particular pursuant to a law, regulation or as a result of a decision of a competent court which has become res judicata, shall not render the other clauses of the general terms and conditions of sale invalid.

20. DISPUTES
